1. Introduction

These Terms and Conditions of Sale ("Terms") govern your purchase and use of SportGene testing services provided by Theorem Metabolic Limited ("we", "us", "our", "the Company"), registered in England and Wales under Company Registration Number 16541987. By booking or using our services, you agree to be bound by these Terms.

Please read these Terms carefully before using our services. If you do not agree to these Terms, you should not use our services.

Our laboratory services are provided through UKAS accredited facilities, ensuring the highest standards of accuracy and reliability for your test results.

2. Your Consumer Rights

As a consumer, you have rights under UK consumer protection legislation that cannot be excluded or limited by these Terms.

2.1 Consumer Contracts Regulations 2013

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

  • You have the right to receive clear information about our services before you make a booking
  • You have a 14-day cooling-off period from the date of booking to cancel without giving a reason, unless you have requested the service to begin within this period
  • If you request the service to begin within the 14-day period and later cancel, you may be charged for the service provided up to that point
  • Once the testing service has been fully performed with your consent, you lose your right to cancel

2.2 Consumer Rights Act 2015

Under the Consumer Rights Act 2015, you have the right to:

  • Services performed with reasonable care and skill
  • Services performed within a reasonable time (typically 5-7 working days for results)
  • Services charged at a reasonable price if no price was agreed beforehand
  • A repeat performance or price reduction if services do not meet these standards

3. Service Description

3.1 What We Provide

  • SportGene DNA testing kits and sample collection materials
  • Sample collection guidance and secure kit return
  • Secure transportation of samples to accredited laboratories
  • Delivery of test results via secure channels
  • General guidance on test results (not medical advice)

3.2 What We Do Not Provide

  • Medical diagnosis or treatment
  • Prescription services
  • Medical advice or second opinions
  • Emergency medical services

4. Booking and Appointments

4.1 Making a Booking

  • Bookings can be made by phone, email, or through our website
  • You must provide accurate personal information when booking
  • You must be 18 years or older to book services (or have parental/guardian consent)
  • Bookings are subject to availability

4.2 Appointment Requirements

  • Bring valid photo identification to your appointment (if applicable)
  • Inform us of any relevant medical conditions or medications
  • Follow any pre-test requirements (e.g., fasting) as advised
  • Arrive on time for any scheduled appointment

5. Cancellation and Rescheduling

5.1 Cancellation by the Client

  • 48+ hours notice: Full refund
  • 24-48 hours notice: 50% refund
  • Less than 24 hours notice: No refund
  • No-show: No refund

5.2 Rescheduling Policy

  • You may reschedule your appointment up to 2 times per booking
  • Rescheduling requests must be made at least 24 hours before your appointment
  • After 2 reschedules, any further changes will be treated as a cancellation

5.3 Late Arrival Policy

  • We allow a 15-minute grace period for late arrivals
  • If you arrive more than 15 minutes late, your appointment may be treated as a no-show
  • Please contact us if you are running late so we can try to accommodate you

5.4 Cancellation by Theorem Metabolic

We reserve the right to cancel or reschedule appointments due to:

  • Unforeseen circumstances or emergencies
  • Equipment failure or supply issues
  • Staff availability

In such cases, we will offer a full refund or priority rescheduling at no additional cost.

6. Payment Terms

6.1 Pricing

  • All prices are in GBP and include VAT where applicable
  • Prices are as quoted at the time of booking
  • We reserve the right to update prices; existing bookings are unaffected

6.2 Payment Methods

  • Payment is required at the time of booking or service
  • We accept card payments, bank transfers, and cash
  • Invoices for corporate clients are payable within 14 days

7. Refunds

  • Refunds for cancelled services are processed within 5-10 working days
  • No refunds are available once samples have been dispatched to the laboratory
  • Refunds due to sample rejection or laboratory issues will be assessed case-by-case

8. Test Results

8.1 Sample Collection

  • Sample collection is performed using sterile, single-use equipment
  • Some minor discomfort may occur during collection; this is normal
  • In rare cases, a sample may be unusable and require a replacement kit

8.2 Results Delivery

  • Results are typically available within 5-7 working days
  • Results are delivered securely via email or our client portal
  • Turnaround times are estimates and may vary depending on the specific tests ordered
  • We will notify you if there are any delays

8.3 Laboratory Accreditation

All samples are analysed by UKAS accredited laboratories, ensuring results meet the highest standards of accuracy and reliability.

9. Health and Safety

9.1 Your Responsibilities

  • Provide accurate personal and health information
  • Disclose relevant medical history and medications
  • Follow pre-test instructions (fasting, hydration, etc.)
  • Inform us of any adverse reactions during or after the procedure
  • Seek appropriate medical advice regarding your results

9.2 Medical Disclaimer

Our services do not constitute medical advice. Test results should be reviewed with a qualified healthcare professional. We are not responsible for any medical decisions made based on our test results.

10. Privacy and Data Protection

We handle your personal data in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR. By using our services, you consent to the collection and processing of your data as described therein.

All content on our website and materials, including logos, text, graphics, and software, is owned by or licensed to Theorem Metabolic Limited. You may not reproduce, distribute, or create derivative works without our written consent.

11. Liability and Limitations

11.1 Limitation of Liability

To the fullest extent permitted by law (and subject to your statutory rights as a consumer):

  • Our total liability is limited to the amount paid for the service
  • We are not liable for indirect, consequential, or incidental damages
  • We are not liable for actions taken based on test results
  • We are not liable for laboratory errors or delays beyond our control

11.2 Accuracy

While we use UKAS accredited laboratories and follow best practices, we cannot guarantee:

  • 100% accuracy of all test results
  • Detection of all conditions or markers
  • Suitability of tests for specific diagnostic purposes

12. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather, or acts of God
  • Pandemic, epidemic, or public health emergency
  • Government actions, strikes, or civil unrest
  • Laboratory closures or supply chain disruptions

In such circumstances, we will make reasonable efforts to minimise disruption and offer rescheduling or refunds where appropriate.

13. Complaints and Disputes

13.1 Complaints Procedure

  • Step 1: Contact us at info@theorem.fit within 30 days of the issue
  • Step 2: We will acknowledge your complaint within 3 working days
  • Step 3: We will investigate and respond within 14 working days
  • Step 4: If unresolved, you may escalate to relevant regulatory bodies

13.2 Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.

We will notify you of any material changes by email or prominent notice on our website at least 14 days before they take effect.
